Additional Efforts to Halt EPA Climate Change Regulation

Two more House bills aim to curb EPA’s regulatory authority.

An earlier essay analyzed the use of the Congressional Review Act (CRA) to block the U.S. Environmental Protection Agency’s (EPA) efforts to regulate greenhouse gases under the Clean Air Act.  In addition to Sen. Murkowski’s proposed joint resolution that would block EPA’s endangerment finding, at least two bills have been introduced in the House that would amend the Clean Air Act to remove EPA’s authority to regulate greenhouse gases.

Last week, Representative Ike Skelton (D-MO), Collin Peterson (D-MN), and Jo Ann Emerson (R-MO) introduced H.R. 4572 that would remove greenhouse gases from the definition of “air pollutant” under the Clean Air Act.  Representative Earl Pomeroy (D-ND) introduced H.R. 4396 in December that would do the same.
In other developments, yesterday the Southeastern Legal Foundation filed a petition for review of the EPA’s endangerment finding in the U.S. Court of Appeals for the D.C. Circuit.  SLF is representing 13 Republican Members of Congress plus a number of businesses and trade groups.
